Please read the following carefully as the terms and conditions outlined in this document constitute an agreement between any user of the Zone Fresh Gourmet Markets Online Shop and the Zone Fresh Group. This agreement is recognised and applicable under Queensland Law.

1. You are bound by and must adhere to the terms and conditions of this service when you obtain products from the Zone Fresh Group via the use of this site, or by completing registration with the Zone Fresh Group.
1.1 Please refrain from using this service if you are under the age of 18 years old and contact your legal parent or legal guardian to process a sale.Â

3. Registration
3.1 Any purchase of goods via the Zone Fresh Gourmet Markets Online Shop will require registration via the submission of a valid email address and relevant personal details for the purpose of our delivery and our best service.
3.2 To register an online order with this service you must be over 18 years of age and ensure that the details submitted in this process are true, correct and complete at the time of order.
3.3 The personal and payment details you give us are strictly private and confidential and will be used only to facilitate the sale for which they are required, unless otherwise agreed.Â
3.4 Upon successful completion of your order you will receive a confirmation email outlining your order and the agreed delivery time and summary of charges.
4. Security
4.1 If the Zone Fresh Group has reason to believe that there is likely to be a security breach, or that this service is being misused, they reserve the right to cancel, refund your order or deny service in accordance with paragraph 7.9
4.2 The Zone Fresh Group will at no stage retain your credit card details as all transactions and payments will be handled directly by our banking facility. However, a record of your sale will be retained along with your email and personal details for the purpose of our delivery and sales records.
4.3 A facility will be made available for return users of this service to recall their previous order upon entering their email address. This option will only be employed should the user wish or agree to have it enabled. An option at the end of each completed order will be provided for users to ‘opt-in’ to this feature.
5. Payment
5.1 The Zone Fresh Group will at no stage retain your credit card details as all transactions and payments will be handled directly by our banking facility. Â
5.2 You must provide the Zone Fresh Gourmet Markets Online Shop with valid debit or credit card details that carry the Master Card, Visa or Bankcard insignia. It is your responsibility to immediately update or inform the Zone Fresh Group of any changes to these details, or issues of validity.
6. GST
All fees and charges and purchases relating to the Zone Fresh Gourmet Markets Online Shop and/or ordering are subject to GST where applicable.
7. Online orders and purchasing
7.1 The Zone Fresh Online Shopping facility and all corresponding agreements, conditions and consequent communications with the Zone Fresh Group will be conducted in the English language.Â
7.2 You should submit an order only after reviewing your selected products in our cart feature. Your order submission amounts to an offer to purchase products from us as specified in your cart selection. You can not withdraw your order once submitted, unless it qualifies under paragraph 7.9
7.3 You should not consider your order to be accepted until you have received either written confirmation of our intention to fulfil your order, or the ordered goods are physically received. Once either of these conditions has been reached a contract of sale will arise.
7.3 Once a contract of sale has been reached, we will do all that we are reasonably able, to ensure that your order is filled. However, many of our products are subject to factors of seasonal and conditional availability and demand, which are beyond our immediate control. In instances where an item that you have ordered has become unavailable, we will inform you and ensure that you are not charged for this item. If you have already paid for this item then we will refund its price in full.Â
7.4 The Zone Fresh Group and Online Shopping facility will bear no responsibility or liability for any product unavailability.
7.5 Should an instance occur where we have supplied you with an incorrect or missing product the Zone Fresh Group will agree to provide, collect and exchange or collect and refund said item at our soonest available opportunity. The Zone Fresh Group will accept no responsibility or liability for any loss or inconvenience incurred by the purchaser in the event of an incorrect or missing product.
7.6 All products are subject to price movements and we strongly advise our online customers to review their cart closely before submitting their order. Once orders have been submitted products will be charged at the quoted price as displayed in their cart at time of submission and will not be affected by future price movements.
7.7 Once you have either been advised in writing that your order has been completed and paid for, or taken receipt of goods, you forfeit your ability to cancel, add too or amend your order. Exceptional circumstances are outlined in paragraph 7.9
7.8 Delivery and/or packaging charges may occur and will apply to any order and/or purchase where these charges are stated. These charges may increase or decrease at any time and will be outlined in your cart prior to completing your order.
7.9 In instances where payment has been made fraudulently, you are entitled to cancel payment for the order. Should payment have already been made where your payment card has been used fraudulently, then you should approach your credit provider, bank or card issuer to initiate their refund procedure. Â
7.10 Product images are correct at time of publishing and subject to change by a supplier without our knowledge. Although our goal is to incorporate current product images, please note that products may undergo changes periodically, and there might be a slight delay in updating them. If you are uncertain, feel free to reach out to us for confirmation.
7.11 All ingredients and allergens should be checked on the product packaging when delivered before consumption.
7.12Â Under the Liquor Act 1982- It is an offence to sell or supply to or to obtain liquor on behalf of a person under the age of 18 years it is illegal to sell wine to anyone under the age of 18. By placing an order with Zone Fresh in partnership with Trentham Estate you confirm that you are at least 18 years of age. Remember, it is an offence to obtain liquor on behalf of a person under the age of 18 years; this includes purchasing the wines as a gift. If in doubt our couriers may request some form of ID with proof of age at the time of delivery. (LIC. NO. 24001559).
8. Delivery
8.1 It remains your responsibility to ensure that appropriate arrangements are made to receive your delivery of goods from the Zone Fresh Group. Should you be unavailable to collect your goods, a Zone Fresh staff member will contact you via phone to notify you that your goods have been delivered.
8.2 We will do our upmost to deliver purchased goods within the arranged time frame. However, we will not accept liability for any loss or inconvenience should your order be delivered outside of the allocated timeframe.
8.3 We do not accept liability should your delivery be damaged or stolen from your property.
8.4 The Zone Fresh Group will guarantee the quality and freshness of goods for a period of two hours after delivery has been made to the value of the goods or order in question. We will not be held liable for goods spoiled or effects caused by goods that have been incorrectly stored or collected after this period.
8.5 Delivery is offered strictly within and confined to the specified delivery area. It is your responsibility to ensure that you are included in the specified delivery area prior to completing your order. Should you be uncertain if you are included in this area please contact the Zone Fresh Head Office on (contact us) we would be happy to confirm this for you.
9. Exclusions
9.1 It remains your responsibility to ensure that you obtain all necessary equipment and/or services needed to access and utilise the Zone Fresh Gourmet Markets Online Shopping service. Â
10. Website availability
10.1 The Zone Fresh Gourmet Markets Online Shop endeavours to offer you a simple, convenient and accessible service at all times. However, instances may occur where this service becomes unavailable or faulty. If service falters, please contact us at our Head Office (contact us) and we will do our best to make the necessary corrections to our service as quickly as reasonably possible.
10.2 Should the Zone Fresh Gourmet Markets Online Shopping service falter or be restricted for the purpose of repairs or maintenance, we will not be held responsible for any loss, or inconvenience to our customers. Further to this, all completed orders and delivery schedules will still apply.

12. Cancellation
12.1 The Zone Fresh Group reserves the right to cancel any accepted order or registration at any time. You will be duly notified of any cancellation and any payment will be reimbursed where appropriate and in accordance with the terms and conditions outlined in this document.
12.2 You may cancel your registration with the Zone Fresh Group by submitting your request in writing. Upon receiving your request your email address will be removed from our online shopping program. We will not be held liable for any information held by your individual computing system, internet browser or browser cache memory relating to the Zone Fresh Gourmet Markets Online Shopping service and relevant personal details.
13 Liabilities
13.1 The Zone Fresh Gourmet Markets Online Shop is provided as a service by the Zone Fresh Group without any warranties or guarantees save those covered in these terms and conditions.
14. Third party websites
